What is property conveyancing?

Property conveyancing describes the process used to transfer property ownership from one person to another. The process is conducted by a conveyancing solicitor. When acting for a buyer, it is their role to ensure that their client obtains the deeds correctly transferred to them by the Land Registry, and that every stage is adequately completed.

When acting for the seller, it is the conveyancing solicitor’s responsibility to obtain a copy of the deeds and any supporting documentation, and to provide a contract package to the buyer’s solicitors. The conveyancing process covers all of the legal and admin tasks that need to be completed before the transaction is legally binding.

How long does conveyancing take?

Your average residential conveyancing transaction should take approximately 12-16 weeks, yet timing may vary according to different factors. For instance, transactions without a property chain may take as little as eight to ten weeks, whereas longer chains may exceed 16 weeks.

How much does conveyancing cost?

The cost of conveyancing will largely depend on factors such as the type of transaction, the value of the property and whether the matter is straightforward or more complex.

What are the steps of conveyancing?

The residential property conveyancing process usually depends on the type of conveyancing transaction. Typically, for a purchase you’ll move through the following steps:

  • The party who is buying the property has their offer accepted and requests their conveyancing solicitor to assist them
  • The buyer may then request that a property survey is carried out
  • If the buyer is obtaining a mortgage, the solicitor will review the mortgage offer to ensure there are no errors
  • The lawyer representing the buyer reviews the contract and raises and necessary enquiries and conducts property searches as required
  • Once the enquiries have been responded to, the mortgage offer and the searches received, the solicitors will send a contract report to the buyer to sign
  • At this stage, completion dates will be discussed, and the deposit requested
  • Both parties agree on the completion date
  • The contracts are exchanged
  • Completion takes place on the agreed date
  • The seller vacates the property, and the keys are given to the buyer
  • The property Title Deeds are forwarded to the solicitor who is working for the buyer
  • The seller’s signed transfer is sent to the Land Registry who will then update the title into the buyer’s name
What is a draft contract?

The draft contract refers to the primary version of the contract that will later make the property sale legally binding. The contract is initially referred to as a draft contract because it is not a legal contract until the buyer and the seller have exchanged contracts and the buyer has paid the deposit.

What is a property survey?

A property survey refers to an inspection and review process that’s conducted by a professional surveyor. The process is used to assess the condition of a property that is being purchased, and to create a report on structural issues or significant repairs.

The result of the survey may influence whether or not the buyer wishes to proceed with the transaction, for instance, if it is discovered that there are major structural problems with the building that may be expensive. When buying a property with a mortgage, the lender will carry out a basic valuation. For a further in-depth valuation and full survey, a Homebuyers Report is recommended.

What is the exchange of contracts?

Exchange of contracts refers to the stage where the buyer and the seller have signed their contracts, agreed a completion date and the buyer has paid the deposit to their solicitor. The solicitors will exchange contracts over the phone. The buyer/seller do not need to be present once they have given their solicitor authority to exchange.

Once the contracts are exchanged, both parties are legally obliged to continue with the transaction. If the buyer pulls out after exchange, they will forfeit the deposit and be liable to pay interest to the seller. When is completion day?

Completion day refers to the final step in the purchase and sale process, when ownership is transferred from the current owner to the buyer. The seller leaves the property, and the buyer is given the property keys. Completion day is the final stage of the conveyancing process, usually 12-16 weeks after the buyer’s offer is initially accepted.

What are the key documents I need to provide to my conveyancer?

You will usually need to provide proof of identity and address, such as a passport or driving licence and a recent utility bill or bank statement, to meet legal requirements.

Depending on your transaction, you may also need to supply evidence of funds, details of your mortgage offer, and property-specific documents if you are selling. Your conveyancer will confirm exactly what is required and when to avoid delays.

What are property searches, and which ones are mandatory during conveyancing?

Property searches are checks carried out to identify issues that could affect the property or its value, such as planning restrictions, environmental risks or drainage connections.

Most transactions, particularly those involving a mortgage, require mandatory searches. These usually include local authority, drainage and water, and environmental searches. Your conveyancer will advise which searches are needed and explain the results clearly.

When do you pay conveyancing fees?

Some costs, such as search fees, are usually paid at the start of the conveyancing process.
